Terms of Service

The rules of the road for using Tacked. Plain English where possible. Applies to web, iOS, and Android.

These Terms of Service ("Terms") govern your use of Tacked ("the Service"), operated by Tacked LLC, a Massachusetts limited liability company ("we," "us," "our"). By creating an account or using the Service on any platform — including the web app at app.tacked.io, the iOS app on the Apple App Store, or the Android app on Google Play — you agree to these Terms.

1. What Tacked Is (and Isn't)

Tacked is a building code reference and contractor productivity toolkit. It provides code lookup, inspection checklists, permit preparation tools, project management features, photo documentation, and related contractor tools.

Tacked is not a substitute for licensed professional advice. The Service provides informational code references and AI-assisted answers that cite code sections. These are reference tools — not engineering, architectural, or legal advice. You are responsible for verifying all code information with your local Authority Having Jurisdiction (AHJ) before relying on it for construction decisions.

We do not guarantee the accuracy, completeness, or currency of code information. Building codes vary by jurisdiction, are subject to local amendments, and change over time. Always confirm with your AHJ.

2. Accounts

You must create an account to use Tacked. You agree to provide accurate information and keep your login credentials secure. You are responsible for all activity under your account.

You must be at least 18 years old to use Tacked. If you are using Tacked on behalf of a company, you represent that you have authority to bind that company to these Terms.

3. Where Tacked Is Available

Tacked is offered through three distribution channels:

Some features may be unavailable or behave differently across platforms (for example, native voice input, push notifications, and offline mode rely on platform-specific capabilities). Your account, projects, notes, photos, and other content sync across platforms when you sign in with the same credentials.

Free Plan

The Free plan includes 5 code questions per day, 6 tools, and 1 project. No credit card required. Free plan features may change over time.

Pro Plan ($9.99/month or $99.99/year)

Includes unlimited code questions, all 25+ tools, unlimited projects, photo annotation, punch lists, materials calculator, code comparison, voice notes, inspection reminders, branded PDF exports, and offline mode. Starts with a 7-day free trial.

Team Plan ($34.99/month or $349.99/year)

Includes everything in Pro plus up to 5 team members, shared project dashboards, role-based access control (Owner / Admin / Member), cross-device sync, team activity feed, and inspection reminder notifications. Starts with a 7-day free trial.

Prices are in U.S. dollars and may vary by region, currency, and tax. The price displayed at the time of purchase is the price you pay for that billing period.

5. How Subscriptions Are Billed

How your subscription is billed and managed depends on where you signed up:

Web (app.tacked.io)

Web subscriptions are billed by Stripe on our behalf. Your payment information is handled directly by Stripe and never stored on our servers. Stripe's terms apply at stripe.com/legal. You can cancel anytime from Settings, which opens the Stripe customer portal.

iOS (Apple App Store)

If you subscribe inside the iOS app, payment is processed by Apple through your Apple ID and the App Store. Apple's Media Services Terms and Conditions apply. To manage or cancel, open Settings → [your name] → Subscriptions on your iOS device, or visit your subscription page on apps.apple.com. We do not have access to your Apple payment information and cannot issue refunds for App Store purchases — refunds are handled by Apple at reportaproblem.apple.com.

Android (Google Play Store)

If you subscribe inside the Android app, payment is processed by Google through your Google account and Google Play. Google Play Terms of Service apply. To manage or cancel, open the Google Play Store app → Profile icon → Payments & subscriptions → Subscriptions, or visit play.google.com/store/account/subscriptions. Refunds for Play Store purchases are governed by Google's refund policy.

6. Auto-Renewing Subscriptions

All paid plans are auto-renewing subscriptions. The following terms apply to all auto-renewable subscriptions, regardless of platform:

7. Your Data

What You Own

You retain ownership of all content you create in Tacked, including project notes, daily logs, photos, drawings, punch lists, contacts, and any other user-generated content. We do not claim ownership of your data.

What We Can Do With It

You grant us a limited license to store, process, display, and transmit your content solely to provide the Service to you and your team members. We do not sell your data to third parties.

Shared Projects

When you share projects with team members, those team members can view and contribute based on their assigned role (Owner, Admin, or Member). You control who has access through the Team Manager in Settings.

Deletion

You can delete your account and all associated data at any time from Settings. Account deletion is permanent and cannot be undone. When you delete your account, your projects, notes, photos, and all other data are removed from our systems. See our Privacy Policy for full details on data handling.

8. AI-Powered Features

Tacked uses AI (powered by Anthropic's Claude) to provide code answers, plan reviews, code comparisons, and other features. AI-generated content:

Your code questions and AI interactions may be used to improve the Service. They are not shared with other users or sold to third parties.

9. Photo and Drawing Features

Photos you upload or capture are stored in your account. When you annotate a photo (arrows, text, circles), the annotations are permanently baked into the image. Annotated photos cannot be reverted to the original.

Photos shared via team projects are accessible to team members based on their role. You are responsible for ensuring you have the right to upload and share any photos you add to Tacked.

Tacked, its design, code, tools, content, and branding are owned by Tacked LLC. Building code text referenced by Tacked is owned by the respective code development organizations (ICC, NFPA, etc.). Tacked provides references and citations — not reproductions of copyrighted code text.

13. Apple App Store — Additional Terms

The following additional terms apply if you obtained the Service from the Apple App Store. These provisions are required by Apple under Schedule 2 of the Apple Developer Program License Agreement:

Acknowledgement

You and Tacked LLC acknowledge that these Terms are concluded between you and Tacked LLC only, and not with Apple Inc. ("Apple"). Tacked LLC, not Apple, is solely responsible for the Service and its content.

Scope of License

Your license to use the iOS app is non-transferable and limited to use on Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, including the Family Sharing rules.

Maintenance and Support

Tacked LLC is solely responsible for providing any maintenance and support services for the iOS app. Apple has no obligation whatsoever to furnish maintenance or support services.

Warranty

Tacked LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the iOS app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the iOS app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Tacked LLC's sole responsibility.

Product Claims

Tacked LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the iOS app or your possession and use of it, including: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

Intellectual Property Rights

In the event of any third-party claim that the iOS app or your possession and use of it infringes that third party's intellectual property rights, Tacked LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Legal Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the iOS app — for example, your wireless data services agreement.

Third Party Beneficiary

You and Tacked LLC acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

14. Google Play Store — Additional Terms

If you obtained the Service from the Google Play Store, the Google Play Terms of Service apply in addition to these Terms. To the extent these Terms conflict with the Google Play Terms with respect to use, distribution, or billing of the Android app, the Google Play Terms control. Subscription management, payment, and refunds for the Android app are handled by Google in accordance with Google Play's policies.

15. Export Controls

The Service is controlled and operated from the United States. You agree to comply with all applicable U.S. and foreign export laws and regulations. You represent that you are not located in, under the control of, or a national or resident of any country to which the U.S. has embargoed goods, and that you are not a person on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Denied Persons List or Entity List.

16. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components.

17. Limitation of Liability

To the maximum extent permitted by law, Tacked LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

You acknowledge that building code compliance is your responsibility. Tacked is a reference tool. Final decisions about construction, permitting, and code compliance must be made by qualified professionals and confirmed with your local AHJ.

18. Indemnification

You agree to indemnify and hold harmless Tacked LLC, its officers, directors, employees, and agents — and, to the extent these Terms apply to use of the iOS app, Apple Inc. and its subsidiaries as third-party beneficiaries — from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

19. Changes to Terms

We may update these Terms from time to time. We'll notify you of material changes via the email associated with your account. Continued use of the Service after changes constitutes acceptance.

20. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. Your data is removed in accordance with Section 7.

21. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Massachusetts, and you consent to the exclusive jurisdiction and venue of those courts.
